Seattle Seahawks Win NFC Championship, Worst MLK Day Tweet Award

Congratulations to the Seattle Seahawks, who won the NFC championship and will play in the Super Bowl. While it’s great that the team is posting celebratory tweets, they proceeded to tie the team’s victory over the Green Bay Packers in with the holiday honoring Martin Luther King, Jr. What could possibly go wrong with that idea?

We missed the tweet, since at least the team had the good sense to delete it when the backlash started. Fortunately, alert person Drew Olanoff got an iPhone screen shot before that happened. seahawks

As always happens when a brand posts a tweet that doesn’t go over well, the Seahawks posted an apology for comparing the end of legal racial segregation to winning a football game.

We haven’t seen any inappropriate brand promotions or tweets, but that doesn’t mean that no brands have made any missteps. If you spot any, send them to us so we can share with the world..

At Target, Fifty Shades Of Grey Brand Sex Toys Belong Next To Kids’ Toothbrushes

50shadesoftoothbrushNo one should be surprised that there’s merchandise based on the inexplicably popular Fifty Shades of Grey book trilogy. We’ve already featured officially licensed wine and unofficial yet disturbing baby clothing. Yet one shopper in Oklahoma was a little surprised to find a rack of officially licensed “Fifty Shades” merchandise next to dental care products for children.

The original tweet was aimed at Target, but also sent over to Jezebel, which wrote a post about the display.

A few days later, Target finally answered.

The items on the display appear to be the officially licensed blindfold set, “vibrating ring,” and either the massage oil or the personal lubricant.

This merchandising makes sense in that the “Fifty Shades” merch is probably stocked near the condoms, which fits into the broad “health and personal care” category along with toothbrushes. There has to be a less hilarious shelf to put this rack on other than next to the Captain America toothbrushes, though. Doesn’t there?

It could have been a sly prank or an accident, but probably the worst consequence was that a few parents had to explain that a “love ring” is something for grown-ups, and hey! Look at the new Angry Birds toothbrush over there!

Boston Taxi Drivers Sue City For Allowing Uber, Lyft To Operate

City authorities in places like Portland, San Francisco, and L.A., have each taken legal actions against ridesharing services like Uber, and taxi drivers around the country have accused these companies from sidestepping regulations. But a recently filed lawsuit by Boston taxi drivers points the blame-finger at the city for allowing Uber, et al, to operate.

The suit [PDF], filed in U.S. District Court last week by two cab drivers and the Boston Taxi Owners’ Association, accuses the city of “imposing extensive, costly and burdensome” regulations on city taxi operators, but not placing the same rules on Uber, Lyft, Sidecar and other rideshare companies operating in the area.

The suit claims that proposed city regulations would effectively give the city’s blessing to a two-tier system for what are essentially identical services.

According to the plaintiffs, Boston aims to allow Uber, etc, to “use practically any vehicle, charge any fare and not obtain commercial insurance, while requiring taxicab medallion owners and drivers to use specific vehicles, charge set rates, obtain certain insurance and incur mandated expenses.”

They believe that this alleged disparity would violate the 14th Amendment of the U.S. Constitution.

It would also, alleges the complaint, violate medallion-holders’ right to due process by both eliminating a cap on the number of medallions available and forbidding holders from transferring them to others. They maintain this renders current medallions worthless.

Regardless of these pending regulations, the plaintiffs argue that the mere fact that the city allows ridesharing services to operate without being held to the same standards as cab companies is unfair.

“The Plaintiffs have invested substantial capital in complying with the City rules and state laws, developed over the last eighty years” reads the complaint, which states that these rules exist to “protect consumers, ensure public safety and provide non-discriminatory service.”

The drivers don’t see why, just because you can use a smartphone to hail an Uber car, the service should face fewer regulations.

“Use of a smartphone app does not change the nature of the business,” argues the complaint. “It does not alter the need for uniform rules for all who engage in it… An app does not make a car safer, qualify or train a driver, protect the passenger, or insure the public when accidents occur.”

The plaintiffs are seeking to have the pending regulations invalidated by the court, and for the court to declare that all for-hire drivers must comply with existing state and local laws governing taxis. And until Uber, et al, do comply, the plaintiffs want them barred from offering for-hire transportation services.
